A Lie is a Lie is a Lie: Toward a Broader Application of the Tailored Testimony Rule

In our Litigation/Appellate Strategy & Advocacy Group's latest article in the New York Law Journal we emphasize that the “tailored testimony” rule should not only be utilized more frequently in the classic summary judgment affidavit context, but should also be applied across-the-board in any situation where a litigant subsequently changes their story without an accompanying legitimate explanation for the change. This should provide litigants and the Courts with a valuable tool to eliminate frivolous claims and defenses and help decrease the anticipated systemic post-Covid19 congestion and delays.
