Appellate Victory in the Second Department

We are pleased to share that our partners Christopher Simone and Nicholas Tam secured a successful result on appeal in the Appellate Division, Second Department. Chris authored the brief, and Nick delivered the oral argument.

In a slip-and-fall case outside a hospital, the Court affirmed dismissal of the complaint, holding that the plaintiff could not identify the location or the cause of her fall.

The Court also rejected an affidavit submitted in opposition to summary judgment as an improper attempt to create a factual dispute.
