Another Successful Summary Judgment Motion

Congratulations to Colleen Buckley, Kelsey O’Brien and Lena Holubnyczyj on a successful summary judgment motion in a case involving an alleged failure to properly treat mitral valve disease allegedly resulting in worsening of the valve and a delay in surgical repair.  In its 13-page decision, the court agreed that the defendants properly diagnosed and treated the plaintiff’s presenting condition in order to stabilize him for the anticipated surgery, while simultaneously  monitoring his cardiac disease.  The court further agreed that the treatment rendered by the defendants did not worsen the worsen plaintiff’s mitral valve.
