Joseph Alexander Receives Order of Summary Judgment

In April 2020 Joe Alexander obtained an Order of Summary Judgment from J. McCormick of Supreme Court, Nassau County on behalf of our defendant Community Center.  Plaintiff alleged the defendants failed to follow safety regulations in our supervision of personal trainers who monitored treadmill use.  Plaintiff asserted negligence, and we argued this did not apply but rather his claims were of intentional tort, which were not timely instituted.  We further argued plaintiff did not satisfy the elements necessary for a negligence claim.  J. McCormick agreed, and dismissed the claim, at the same time denying the plaintiff’s cross motion for summary judgment and spoliation.
