Second Circuit Affirms Dismissal in Favor of Hospital Defendants 

Shaub, Ahmuty, Citrin & Spratt, LLP is pleased to share that our partner Nicholas Tam secured an affirmance in the U.S. Court of Appeals for the Second Circuit following dismissal of the complaint by the U.S. District Court for the Eastern District of New York. 

In this matter, the plaintiffs asserted numerous claims against a major hospital institution, the plaintiff’s medical treatment team, and various entities arising from allegations related to medical treatment received in 2024. The plaintiffs asserted a host of claims about purported coordinated efforts to cause them harm prior to treatment, during the admission, and following discharge. 

SACS moved to dismiss the complaint in the E.D.N.Y. The District Court dismissed the complaint on the grounds that the plaintiffs’ complaint - alleging dozens of causes of action against numerous defendants - failed to include a “short and plain statement of the claim showing that the pleader is entitled to relief” as required by Fed. R. Civ. P. 8. Following briefing on appeal, the Second Circuit affirmed the E.D.N.Y.’s decision, agreeing that dismissal of the action was warranted.
