Another victory for Partner Joseph Alexander

Congratulations to Joseph Alexander, who on the eve of trial obtained a discontinuation of all claims against our surgeon and hospital in a high exposure case. The case concerned allegations that defendants were negligent in providing anterior exposure during the 47-year-olds spinal fusion surgery, which resulted in a left leg thrombosis, need for thrombectomy and pain syndrome that cause uncontrollable shaking in the plaintiff’s extremities. Through motion practice, Mr. Alexander was able to establish that informed consent was appropriately obtained, the clot was timely and appropriately responded to post-operatively, and there was no correlation between the clot and plaintiff’s pain syndrome. When faced with the result of the motions, plaintiff’s once multi-million dollar demand was quickly reduced before plaintiff ultimately decided to discontinue the action the day before trial was to commence.
