Another Summary Judgment Win for Joe Alexander

Congratulations to Joseph Alexander, who with the assistance of Anthony Ruzzi and intern Alexandra Yule, obtained an order for Summary Judgment dismissing all claims against our renowned ENT Surgeon, and individually named residents, nurses, and hospital, in a high exposure case.  The case concerned allegations that defendants were negligent in performing the 48-year-olds transoral robotic surgical resection of his tongue carcinoma and neck dissection, which resulted in a post-operative hemorrhage, anoxic encephalopathy, and continued/potentially life long care in an assisted living facility. We established that informed consent was appropriately obtained, prophylactic ligation of the vessel was not the standard of care, the vessel was not injured intraoperatively, and that the plaintiff’s hemorrhage was timely and appropriately responded to post-operatively, and Judge Gandin of the Supreme Court of Ulster County agreed, granting the motion in its entirety.
