A Second Defense Verdict Granted in 2020

In February 2020 Howard Snyder obtained a unanimous defense verdict on behalf of our delivering physician in Queens County before J. Livoti.  The action was brought on behalf of an infant who suffered a brachial plexus injury and permanent Erb’s palsy at birth. The plaintiff argued our physician failed to properly employ the appropriate maneuvers to deliver the child causing the injury; we countered this was an obstetrical emergency with the injury caused by the forces of labor on the impacted right shoulder, which was trapped behind the symphysis pubis.  It was our doctor’s immediate response that prevented further harm.  The plaintiff’s request of $8 million from the jury was rejected with a defense verdict.
