Defense Verdict Achieved for Orthopedic Spine Surgeon
Shaub Ahmuty Citrin & Spratt LLP partners William Spratt and Dominique Chin successfully defended a medical malpractice action at trial in Nassau County Supreme Court, resulting in a defense verdict on behalf of their client, an orthopedic spine surgeon.
The case involved allegations of negligence concerning the indications for an X-STOP implantation procedure performed on the plaintiff-patient, as well as claims that informed consent for the procedure was not properly obtained. As a result thereof, the plaintiff alleged he required surgical removal of the X-STOP devices and a laminectomy approximately ten years later.
In response, the defense demonstrated that the plaintiff’s X-STOP procedure was indicated, informed consent for the procedure was properly obtained, the care rendered to the plaintiff was within the standard of care, and there was no injury from a causation standpoint.
