Defense Verdict in Nassau County Supreme Court 

Congratulations to Shaub, Ahmuty, Citrin & Spratt, LLP senior trial partner Henry Shaub and Of Counsel Michael Pitre on their recent defense verdict in Nassau County Supreme Court. 

The case involved claims of medical malpractice and wrongful death against our client, a local hospital. The plaintiff’s attorney alleged that the hospital failed to obtain a cardiac consultation and were negligent in the surgical clearance and anticoagulation of the then 51-year-old patient who presented to the emergency room following a traumatic injury and in need of a left tibial open reduction and internal fixation (ORIF) surgery, resulting in a fatal stroke postoperatively. 

The defense strategically cross-examined the plaintiff’s experts in hospital medicine, cardiology, radiology, and economics. With the assistance of our experts and our client’s testimony, the defense maintained that the hospital’s care and treatment at all times met the standard of care and did not cause the patient’s death. 

Ultimately, the jury returned a unanimous verdict in favor of the defense on all claims.
