Summary Judgment Granted in Richmond County
Shaub, Ahmuty, Citrin & Spratt, LLP recently obtained full dismissal of all claims brought against their clients, a major hospital, a physician, and a triage nurse.
The case involved allegations surrounding a failure to diagnose an ectopic pregnancy. In moving for summary judgment, associate Elizabeth Gorman argued that the plaintiff was appropriately triaged and voluntarily left the emergency room without notifying any of the hospital staff before they had the opportunity to evaluate her. Liz further argued that no physician patient relationship could be created between the hospital and the plaintiff because she voluntarily left before ever being admitted.
At oral argument, associate Joseph Bias was able to secure a victory on behalf of our clients, referring to the strong arguments made by Liz in her motion.
