Summary Judgment Win Sets Strong Precedent

Shaub, Ahmuty, Citrin & Spratt LLP is pleased to share that Patricia Tierney-Stone and Michael Pitre secured a significant summary judgment victory on behalf of their client, a decision that sets strong precedent moving forward regarding the distinction between health systems vs. hospital liability. 

After extensive efforts to resolve the matter through discussions regarding their client’s status as a non-jural entity, we ultimately proceeded with a motion for summary judgment, despite opposition from plaintiff’s counsel. 

Thanks to Mike’s persuasive briefing and compelling oral argument, the Court ruled in their client’s favor, reaffirming that parent corporations cannot be held liable for the actions of a subsidiary unless they exercise complete dominion and control. 

The Court also rejected the plaintiff’s reliance on vicarious liability caselaw involving hospitals, noting that our client is not a hospital, is not licensed to provide direct health care, and therefore does not fall within that legal framework.
