Victory on Summary Judgment for Jessica George

Jessica George secured a hard-fought victory and obtained dismissal of all claims against our clients, a renowned orthopedic spine surgeon and his practice, in the Supreme Court, Queens County, before Justice Peter O’Donoghue.   Plaintiff’s claims arose from alleged negligence in plaintiff’s post-operative treatment following complex spine surgery, and the alleged failure to prevent formation of an epidural abscess requiring removal and re-instrumentation of hardware and injuries including right foot drop and the need for reconstructive back surgery.  Through the expert affirmations of well-credentialed experts in orthopedic spine surgery and infectious disease, as well as the use of voluminous deposition testimony and medical records obtained throughout the course of discovery, Jessica proved that plaintiff’s expert was unqualified to render opinions regarding defendants’ care and treatment and that plaintiff’s attempt to create feigned issues of fact were insufficient to defeat summary judgment.  The Court agreed and dismissed all claims as to defendants.
