Summary Judgment Secured in Child Victims Act Case
Shaub, Ahmuty, Citrin, & Spratt, LLP recently obtained summary judgment dismissing the complaint against our client, a religious institution, in a revival action alleging negligent supervision and hiring that was brought pursuant to the Child Victims Act.
The plaintiff claimed that she was abused by a member of a religious order when she was four years old and again when she was eighteen years old. SACS obtained dismissal of the claim arising from alleged abuse when the plaintiff was eighteen years old by demonstrating that it was time-barred and was not revived by the Child Victims Act. SACS obtained dismissal of the claim arising from the alleged abuse when the plaintiff was four years old by demonstrating, through the deposition testimony of multiple witnesses and the alleged abuser’s personnel file, that our client lacked actual or constructive notice of the alleged abuser’s alleged propensity to commit abuse.
