Defense Verdict Secured in Nassau County Trial
We are pleased to share that Senior Trial Partner Gerard Cushing and Partner Erin Stalzer recently obtained a defense verdict in Nassau County Supreme Court on behalf of a neurosurgeon and his practice.
The case involved allegations that the defendant negligently failed to appreciate the then 38-year-old plaintiff’s celiac history and enhanced risk for osteoporosis in the pre-operative period, prior to the defendant’s performance of a lumbar spine surgery that failed to fuse. The plaintiff charged that the defendant failed to obtain valid informed consent and negligently failed to refer the plaintiff for preoperative bone density testing and endocrinology evaluation, resulting in her failed fusion, increased pain, and required revision.
With the assistance of our client and our neurosurgical expert, the jury quickly returned a defense verdict confirming that our client’s actions were entirely proper and within the standard of care.
