Appeals Win at the First Department
Shaub, Ahmuty, Citrin & Spratt LLP is pleased to share a recent win by our appellate team.
The First Department affirmed the Supreme Court’s order dismissing the plaintiff’s Labor Law § 240(1) claim, agreeing with our position that the plaintiff was not engaged in a statutorily protected activity at the time of the accident. Instead, the Court found that the plaintiff was merely present at the site to answer questions about work that had already been completed.
