Summary Judgment Granted in Cardiac Malpractice Case
Congratulations to Shaub Ahmuty Citrin & Spratt LLP attorney Daniel Slomnicki on a full dismissal for all three of our clients.
SACS represented a cardiologist, nuclear cardiologist, and a major metropolitan hospital in a case alleging negligent cardiac clearance for an elective knee surgery. The 51-year-old plaintiff suffered a cardiac event during the procedure, resulting in an ICU stay and documented heart damage.
Daniel built a compelling narrative: our cardiology expert confirmed the clearance and stress test were both appropriate and properly interpreted. The turning point came from our anesthesiology expert, who identified that the plaintiff's cardiac arrest was not a true cardiac event, but rather an anaphylactic reaction to Ancef/Cefazolin. The reaction caused plasma to leak from blood vessels, leading to elevated Hemoglobin and Hematocrit levels consistent with anaphylaxis, not cardiac failure.
The evidence spoke for itself. The plaintiff's counsel did not oppose our motion and instead moved to withdraw from the case entirely.
The Court granted summary judgment and dismissed all claims with prejudice.
