Defense Verdict Secured in Nassau County
Congratulations to Senior Trial Partner Marc Citrin and Associate Joseph Bias for recently obtaining a defense verdict on behalf of our clients, two emergency medicine physicians.
The case involved allegations that our clients failed to appreciate signs of arterial insufficiency on two separate emergency room presentations in the then 56-year-old plaintiff. The plaintiff claimed that due to the physicians' alleged departures, he suffered a lower extremity arterial occlusion resulting in the need for a fasciotomy, and an eventual drop foot.
The defense argued that the plaintiff was appropriately evaluated for DVT secondary to his prior medical history, and that no further arterial evaluation was indicated based on the physical examination that was conducted.
With the assistance of our clients’ testimony, and the testimony of both an emergency medicine expert and a vascular surgery expert, the jury quickly returned a defense verdict confirming that our clients’ actions were entirely proper and within the standard of care.
