Defense Verdict in High-Stakes Medical Malpractice Case 

We are pleased to share that Trial Partner, Gerard Cushing, and Of Counsel, Dominique Chin, secured a unanimous defense verdict in Nassau County Supreme Court on behalf of a hospitalist, cardiologist and hospital system.

This case involved allegations of negligence in the pre-operative management and clearance of a then 73-year-old male who presented to the hospital after suffering a hip fracture that required surgical intervention. Specifically, plaintiff alleged defendants improperly cleared decedent for surgery and failed to monitor decedent's fluid status during his hospitalization resulting in fluid overload, PEA arrests and decedent's death.

With the assistance of experts in cardiology and critical care, the jury ultimately agreed that the collective defendants' actions were entirely within the standard of care.
