Insurance Litigation

The Firm has extensive experience and expertise representing and dealing with members of the insurance and reinsurance industries, including matters arising out of the activities of insurers, reinsurers, agents, brokers, and insureds. Insurance company clients represented by our lawyers have run the gamut from small off-shore captives and regional mono-line carriers, to major national and international P&C writers with diverse books of business. On the reinsurance side, our lawyers have represented cedents, reinsurers, and retrocessionaires, in litigation and arbitration arising from both treaties and facultative contracts, placed in direct and brokered markets. In disputes arising out of quota share treaties and similar arrangements, we have experience in jointly representing groups of reinsurers or retrocessionaires with united interests.

Although we are justifiably proud of the results we have achieved for clients in litigation and arbitration, we are also aware clients need sound coverage analysis and counsel at least as much as they need sound advocacy. Because coverage issues arise in almost infinite variety, and because litigation is often not the best way to resolve them, our lawyers often serve clients as legal analysts and advisors, rather than solely as advocates, including through the practice of "preventive" law to try to avoid potential disputes. For example, we analyze complex, unusual, novel, or amorphous coverage issues; provide formal coverage opinions; formulate appropriate coverage positions that best serve the legal and business needs of our clients; advise on and create policy, endorsement, certificate, and treaty language; advise on and draft commutation agreements; review and monitor the activities of underlying insurers or ceding companies; formulate claim-handling procedures and protocols for complex or novel claims; advise on potential "bad faith" issues; prepare reservations of rights and denials of coverage; and monitor and associate in the defense of claims.
